Enders Germany is strongly committed to protecting your privacy. In the following we set out in detail how your personal data is processed by us.

  1. 1. Access data and hosting

You can visit our websites without providing any personal information. Each time you access a web page, the web server will merely automatically save a so-called server log file documenting said call and containing for example the name of the file requested, your IP address, the date and time of the retrieval, the amount of data transferred and the requesting provider (access data).

This access data is used exclusively to ensure that the website operates smoothly and to improve our offering. This serves to protect our legitimate interests in the optimised presentation of our offering according to Art. 6 (1) sentence 1 lit. f GDPR that prevail in the process of balancing of interests. All access data is deleted no later than seven days after the end of your visit to our website.

Third-party hosting services
Data is also processed by a third-party provider that we have engaged to render hosting and website presentation services on our behalf. This serves to protect our legitimate interests in the optimised presentation of our offering that prevail in the process of balancing of interests. All data collected as described below as part of the use of this website or registration forms provided in the online shop will be processed on the third-party provider’s servers. Data shall be processed on other servers only to the extent described in this notice.

Said service provider shall be based within a country of the European Union or the European Economic Area.

  1. Data collection and use for contract execution

We collect personal data that you disclose to us whenever you place an order or contact us (e.g. via contact form or by email). Mandatory fields are marked as such since this data is indispensable in performing the contract or processing your contact request; otherwise you would not be able to complete your order or send the contact request. The relevant entry forms indicate what data is collected. We use the data that you disclose to us to fulfil the contract and process your enquiries according to Art. 6 (1) sentence 1 lit. b GDPR. Upon completion of the contract, your data will be restricted from any further processing and deleted upon expiry of the applicable retention period under relevant tax and commercial regulations, unless you have expressly consented to further use of your data or we reserve the right to further data use in the scope and manner permitted by law, of which we inform you in this notice.

  1. Transfer of data

We disclose your data to the shipping company in the scope required for the delivery of the ordered goods according to Art. 6 (1) sentence 1 lit. b GDPR. Depending on the payment service provider you have selected during the ordering process, we will forward the payment details collected for order processing purposes to the bank commissioned with the payment and, as the case may be, to the payment service provider commissioned by us or to the selected payment service. Some of those data are collected by the selected payment service providers themselves if you create an account with the selected payment service provider. In such a case, during the ordering process, you must register with said payment service provider using your login data. In this context, the privacy notice of the relevant payment service provider applies.

Data transfer to shipping service providers
If you have given us your express consent during or after your order to do so, we will forward your email address and telephone number to the selected shipping service provider pursuant to Art. 6 (1) sentence 1 lit. a GDPR so that said shipping service provider can contact you before delivery for the purpose of delivery notification or coordination.

Consent can be revoked at any time by sending a message to the contact option described below or directly to the shipping service provider at the contact address listed below. After revocation, we will delete your data provided for this purpose, unless you have expressly consented to further use of your data or we reserve the right to further data use in the scope and manner permitted by law, of which we inform you in this notice.

  1. Email newsletter

Email advertising with subscription to the newsletter
If you subscribe to our newsletter, we will regularly send you our email newsletter based on your consent according to Art. 6 (1) sentence 1 lit. a GDPR, using the data required or disclosed by you separately for this purpose.

You may unsubscribe from the newsletter service at any time, either by sending a message to the contact option specified below or by using the opt-out link in the newsletter. Upon unsubscription, we will delete your email address unless you have expressly consented to further data use or we reserve the right to further use your personal data in the scope and manner permitted by law, of which we inform you in this notice.

  1. Cookies and web analysis

We use so-called “cookies” on various pages in order to make our website attractive, to allow the use of specific functions, to display suitable products and for market research purposes. This serves to protect our legitimate interests in the optimised presentation of our offering according to Art. 6 (1) sentence 1 lit. f GDPR that prevail in the process of balancing of interests. Cookies are small text files which are automatically stored on your terminal device. Some of the cookies we use (so-called “session cookies”) are deleted at the end of the browser session, i.e. when you close your browser. Other cookies (“persistent cookies”) remain on your terminal device and allow us to recognise your browser on your next visit. Based on this agreement between the USA and the European Commission, the latter has recognised entities certified to the Privacy Shield as those ensuring an adequate level of data protection.

You can revoke your consent at any time for the future by deactivating the DoubleClick cookie via this link. In addition, you can contact the Digital Advertising Alliance to learn more about how to make cookie settings and accordingly adapt the settings of your browser. Finally, you can configure your browser to inform you when cookies are set and decide on a case-by-case basis whether to accept or reject the cookies on a given website or generally. Use of Google (Universal) Analytics for web analytics
If you have given your consent in accordance with Art. 6 (1) sentence 1 lit. a GDPR, this website will use Google (Universal) Analytics, a web analytics service provided by Google LLC (www.google.com), for website analytics purposes. Google (Universal) Analytics uses methods, e.g. cookies, which allow your use of the website to be analysed. The information regarding your use of our website is collected automatically and will generally be transferred to and stored by Google on a server in the USA. Use of social plug-ins from Facebook, Google, Twitter, Instagram, Pinterest
Our website uses so-called “social plug-ins” (or “plug-ins”) from social networks.
By accessing a page on our web site that contains such a plug-in, your browser will connect with the corresponding Facebook, Google, Twitter or Instagram server. The content of the relevant plug-in will then be transferred by the plug-in provider straight to your browser and incorporated into the page.   1. Contact data and your rights

As the person concerned, you have the following rights:

  • In accordance with Art. 15 GDPR, the right to obtain information about your personal data which we process, within the scope described therein;
  • In accordance with Art. 16 GDPR, the right to immediately demand rectification of incorrect or completion of your personal data stored with us;
  • In accordance with Art. 17 GDPR, the right to request erasure of your personal data stored with us, unless further processing is required
    – to exercise the right of freedom of expression and information;
    – to fulfil a legal obligation;
    – for reasons of public interest; or
    – to assert, exercise or defend legal claims.
  • In accordance with Art. 18 GDPR, the right to request restriction of processing of your personal data, insofar as
    – you contest the accuracy of said data;
    – the processing is not lawful but you decline to have the data deleted;
    – we no longer need the data but you require it in order to assert, exercise or defend legal claims; or
    – you have objected to the processing of data in accordance with Art. 21 GDPR;
  • In accordance with Art. 20 GDPR, the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request its transmission to another body responsible;
  • In accordance with Art. 77 GDPR, the right to complain to a supervisory authority. To do so, you can generally contact the supervisory authority at your usual place of residence, your workplace or our company headquarters.

Right to object
To the extent that we process personal data as described above to safeguard our justified interest – an interest prevailing when the interests of all parties are taken into account – you can object to this processing for the future.
